General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to orders for products and services placed through the website stilleform.ch and, where applicable, to enquiries and bookings confirmed directly by STILLE FORM STUDIO SAGL.

2. Products and Services

STILLE FORM STUDIO SAGL offers products, decorations and event styling services, in particular balloon decorations and personalised products for private and corporate events.

Images displayed on the website are for illustrative purposes. In particular, handmade or personalised products may show slight variations in colour, shape, size or arrangement compared with the images displayed on the website.

3. Conclusion of the Contract

The presentation of products and services on the website does not necessarily constitute a binding offer.

By submitting an order subject to payment, the customer makes a binding offer to purchase the selected products or services.

Before submitting the order, the customer has the opportunity to review and correct the information provided.

The contract is concluded when STILLE FORM STUDIO SAGL confirms the order.

Requests for quotations submitted through the website do not constitute a binding order. A contract is concluded only after the quotation has been accepted or the order has been confirmed in accordance with the conditions communicated to the customer.

4. Prices

All prices are stated in Swiss francs (CHF) and include the applicable value added tax (VAT), unless otherwise indicated.

The total price applicable to the order, including any additional costs for delivery, setup or other selected services, will be communicated to the customer before the order is completed or specified in the quotation.

5. Payment

The available payment methods are displayed during the ordering process.

Online payments may be processed through external payment service providers, in particular Stripe.

For individually agreed orders, services or quotations, other payment arrangements may apply. These will be communicated to the customer before final confirmation.

Unless otherwise agreed, payment must be made in accordance with the conditions stated at the time of ordering or in the quotation.

6. Delivery and Setup

STILLE FORM STUDIO SAGL provides deliveries and, where agreed, setup services mainly in Chur and the surrounding area.

The availability of delivery, any applicable charges and the relevant conditions will be indicated during the ordering process, in the product description or in the quotation.

The date and time window for delivery or setup will be agreed with the customer or, where available, selected during the booking process.

The customer is responsible for providing accurate and complete information regarding the delivery address, access to the event location and any special circumstances that may affect delivery or setup.

7. Personalised Products and Right of Withdrawal

Under Swiss law, there is generally no statutory right of withdrawal or cancellation for online purchases.

Many of the products and decorations offered by STILLE FORM STUDIO SAGL are also individually created according to the customer’s specifications, for example with regard to colours, text, names, numbers, sizes, themes or arrangements.

Unless otherwise expressly agreed in writing, no voluntary right of withdrawal, cancellation or return is therefore granted for personalised or made-to-order products.

Any mandatory statutory rights of the customer in the event of defective products or products that do not conform to the agreed specifications remain unaffected.

8. Changes and Cancellation of Orders

Requests to change or cancel an order must be communicated to STILLE FORM STUDIO SAGL as early as possible.

Changes or cancellations are possible only after confirmation by STILLE FORM STUDIO SAGL.

If production of a personalised product has already begun, specific materials have already been purchased for the order, or costs have already been incurred in preparation for an event, STILLE FORM STUDIO SAGL reserves the right, to the extent permitted by law, to charge the customer for costs already incurred and work already performed.

Specific cancellation conditions for decoration services or events may also be defined in the relevant quotation or order confirmation.

9. Delivery, Delays and Circumstances Beyond Our Control

STILLE FORM STUDIO SAGL makes every reasonable effort to comply with agreed dates and time windows.

In the event of unforeseen circumstances or events beyond our control that make delivery or performance of the service impossible or significantly more difficult, the customer will be informed as soon as possible and an appropriate solution will be sought.

10. Complaints and Defects

Customers are requested to inspect the products upon delivery and to notify us of any defects or problems as soon as possible.

In the event of a proven defect or a product that does not conform to what was agreed, STILLE FORM STUDIO SAGL will determine an appropriate solution, taking into account the circumstances of the individual case and the applicable legal provisions.

Mandatory statutory rights remain unaffected in all cases.

11. Balloons and Durability of Decorations

The durability of balloons and decorations may be affected by various factors, including temperature, direct sunlight, wind, humidity, weather conditions and the conditions at the installation location.

For decorations installed outdoors, a specific period of durability therefore cannot be guaranteed, particularly in unfavourable weather conditions.

After delivery or completion of the setup, the customer is responsible for the proper care and handling of the decorations.

12. Liability

STILLE FORM STUDIO SAGL is liable for damages in accordance with applicable Swiss law.

To the extent permitted by law, liability for damages caused by slight negligence is excluded.

To the extent permitted by law, liability is also excluded for damages resulting from improper use of the products, failure to follow instructions provided, actions by third parties or circumstances beyond the control of STILLE FORM STUDIO SAGL.

13. Data Protection

Personal data is processed in accordance with our Privacy Policy, which is available on the website stilleform.ch.

14. Applicable Law and Jurisdiction

These General Terms and Conditions and the contractual relationships with STILLE FORM STUDIO SAGL are governed by Swiss law.

Jurisdiction shall be determined in accordance with the applicable provisions of Swiss law. Mandatory statutory provisions regarding jurisdiction, particularly those applicable to contracts with consumers, remain unaffected.

15. Amendments to the General Terms and Conditions

STILLE FORM STUDIO SAGL reserves the right to amend these General Terms and Conditions when necessary.

Each order is subject to the version of the GTC in force at the time the relevant contract is concluded.
